SC issues notice to BJP MLA in sealing case

The Supreme Court on Thursday issued a contempt notice to Delhi BJP MLA Harsharan Singh Balli for allegedly breaking open shops sealed by the MCD as part of a court-ordered drive against commercial establishments operating in residential areas.

A bench headed by Chief Justice YK Sabharwal asked Balli to explain why action should not be taken against him for violating the court's order.

The court issued notice after the Monitoring Committee brought to its notice a videotape showing Balli breaking seals of shops.

The bench made it clear that no court would entertain any plea regarding the ongoing sealing drive as the matter is being heard by the apex court.

Accepting the Monitoring Committee's recommendation, the court directed the MCD to issue requisite public notice with regard to the action against commercial establishments running from residential premises on roads with a width of 60 feet or more as may be directed by the committee.

The court made it clear that the ongoing sealing and de-sealing operation would continue.

The Committee was also asked to indicate in its next report its perception of small shops.

The court also asked MCD to file an affidavit within four weeks about those violating its order on sealing.

It listed the matter for further hearing on July 17.
