Seal Delhi's illegal commercial units: SC

The apex has directed the MCD to publish the list of Delhi's illegal commercial premises before sealing.

The Supreme Court on Thursday directed the MCD to publish the list of residential premises used for commercial purposes in violation of the rules in Delhi.

The apex court asked the local body to publish the list within ten days in newspapers.

A bench headed by Chief Justice YK Sabharwal directed the owners to stop the misuse of such premises within 30 days of the publication of the list of major violators.

The court said the owners will have to file the affidavit within 30 days with MCD Commissioner that they have stopped the misuse of the premises.

The court made it clear that the sealing of the premises will begin after the expiry of the publication of the list.

The court also said that the MCD will start its action against the major violators on priority.

The bench also clarified that its order is limited only to the misusers of the residential complex.

MCD will have to take action first in the areas where there has been major violations of the rules.

It said that if any tampering is done with the ceiling of the premises, appropriate action will be taken against the violators.

The court directed the MCD Commissioner to file in two weeks on the action taken by the MCD.
