The order was passed by a division bench comprising justices Imtiyaz Murtaza and N A Moonis on the writ petition of Singh, who had on December 5, 2009, obtained a stay on his arrest in connection with the FIR lodged at Babupurwa police station by Kanpur resident Shivakant Tripathi.

Tripathi alleged during SP rule in Uttar Pradesh, Singh had in his capacity as the Chairman of Uttar Pradesh Development Corporation embezzled crores of rupees in the process of awarding contracts to companies.

Singh, who recently resigned from the post of party general secretary, has denied the charges and maintained that it was not within his powers to award contracts.
