Supreme Court dismisses Vikas Yadav's plea

The SC rejected a plea of Vikas Yadav, convicted for killing his sister's friend Nitish Katara, seeking hearing of his appeal against conviction by any high court other than that of Delhi.

The Supreme Court on Wednesday rejected a plea of former lawmaker DP Yadav's son Vikas Yadav, convicted for killing his sister's friend Nitish Katara, seeking hearing of his appeal against conviction by any high court other than that of Delhi.

A bench of Justice Dalveer Bhandari and Justice HS Bedi dismissed the plea saying it did not have any merit.

Vikas Yadav along with his cousin Vishal and some other accomplices were sentenced to life term on May 30 by a sessions court in New Delhi for killing Bharti Yadav's friend Katara near Ghaziabad in Uttar Pradesh in 2002.

On a plea by the victim's mother Neelam Katara, who apprehended that Vikas Yadav's influential father was interfering with probe and trial of the case in Ghaziabad, the Supreme Court had shifted the trial to the Delhi court.

Following his conviction and sentencing, Vikas Yadav had moved the Allahabad High Court challenging his conviction and sentence.

But the high court had refused to hear it saying it was not entitled to hear the appeal against a judgement delivered by a trial court in Delhi. It said the right forum to challenge a Delhi trial court's ruling is the Delhi High Court.
