The District Returning officer registered a case last night on a complaint by representative of Congress candidate from Sagar Aslam Sher Khan, official sources said in Sagar on Saturday.

The case was registered after Tomar, addressing a rally at Bandri on April 15, had remarked, "Why is Afzal Guru, after being awarded capital punishment for attack on Parliament, not being hanged. Is he the son-in-law of Congress or Sonia Gandhi?"

Tomar was addressing a rally in favour of BJP candidate Bupendra Singh. The DRO after an inquiry served 24-hour returnable notice on Tomar on April 22.

However, Tomar did not reply to the notice following which the DRO lodged an FIR yesterday under IPC Sec 171 G (false statement made in connection with election), the sources said.
