BHOPAL GAS Peedit Sangharsh Sahyog Samiti (BGPSSS), who had filed a petition against Bhopal Memorial Hospital & Research Centre (BMHRC) Trust before Registrar Public Trust, today contended that the Trust Deed of August 11, 1998, relates to just Rs 1,000 and subsequent flow of fund for construction of hospital and purchase of property for the hospital was never ‘entrusted’ to it.
Arguing the case before the registrar, Rajesh Umre, BGPSSS counsel K K Joshi said that the funds received from Empowered Committee for construction of hospital and other expenses were never documented and there was no valid entrustment of the same to the Bhopal Memorial Hospital & Research Centre (BMHRC) Trust.
As such, the Trust has no right to administer the hospital, he argued. He said that since the Trust deed was entered upon a cash amount of Rs 1,000 only, Bhopal Memorial Hospital & Research Centre (BMHRC) Trust did not own the hospital nor was it competent to run the hospital.
He further argued that works and responsibilities were never divided among the 11 trustees, leading to poor administration.
Besides, greater attention was being paid to paying patients at the hospital rather than gas victims, defeating the very purpose for which Bhopal Memorial Hospital & Research Centre (BMHRC) Trust was created.
He also said that after the petition, in which non-payment of bills by certain patients was brought to the notice of the registrar, notices have been issued to persons concerned for payment of bills, making it clear that the Hospital Trust has not been honest in realising bills from the paying patients.

{{/usCountry}}He further argued that during the past five years, none of the trustees inspected the hospital nor any of them thought it fit to visit the hospital when there was a prolonged impasse leading to closure of the hospital for 42 days.
It depicts lack of interest on the part of trustees to ensure proper administration of the hospital. He further said that the hospital was not functioning as super-specialty hospital as it ought to have and research on impact on human organs due to exposure to MIC was not carried out at all as mandated by the Supreme Court.
In such a situation, order for an inquiry into affairs of the Trust must be ordered, he prayed.
