The Bombay High Court will decide on July 28 whether the municipal corporation is liable to pay compensation to the seven-year-old Sohail, who is a student of the New Sion Urdu School.

A division bench of Justice Ranjana Desai and Justice V.K. Tahilramani was hearing a petition filed by Sherbano Khan (32) alleging that her son lost his left eyesight due to negligence of a teacher as medical treatment was not provided on time.

S.S. Pakale, counsel of the municipal corporation opposed payment of compensation to Khan saying that it was not a case of negligence.

“This is not a case where compensation can be granted,” argued Pakale.

Bhavesh Parmar, Khan’s advocate, urged in the high court that the petition be kept along with the petition filed by Mohan Nerurkar.

Nerurkar too is also seeking compensation from the municipal corporation after his four-day-old son went missing from Sion Hospital last January.

However, the judges remarked that the two issues were different.

Meanwhile, the school authorities have accepted that at the time of incident there was no teacher in the class, as the in-charge of class was sent on training.
