Though the Central Bureau of Investigation (CBI) has charge-sheeted two senior IAS officials - Pradeep Vyas and Jairaj Phatak - in the Adarsh scam, it is yet to get a sanction from the government to prosecute them.

The charge sheet filed on Wednesday does not include the sanction letter to prosecute Vyas and Phatak.
However, it states the agency has already moved the competent authority seeking sanction to prosecute the duo for their role in the scam.
As per procedure, in order to prosecute any IAS (Indian Administrative Service) officer, the agency has to obtain a sanction from the concerned government where he is deputed.
At the time of arrest four months ago Vyas was posted as secretary, finance department, Maharashtra, while Phatak was serving with the Central government.
Sources said the court cannot prosecute the IAS officers in the absence of sanction from the concerned authorities.
