“Marriage is a necessary part of society. How can you say a wedding cannot be carried out,” a division bench of justice PB Majmudar and justice Mridula Bhatkar asked police authorities who had argued that functions at the gymkhana caused traffic jams in the area.

The divison bencc reminded the police that the traffic problem was prevalent across the city. “Sometimes, a person going to the hospital is stuck because the ambulance is

held up in traffic,” justice Majmudar said.

The trustees of the gymkhana had challenged an order passed by the Lokayukta that restrained it from letting out its ground for social functions and weddings. The order had come after a local resident lodged a complaint saying that the functions were causing nuisance to people residing in the vicinity.

Justice Majmudar also stressed that citizens comfort is vital and directed that any noise that is likely to disturb the peace in the area should not be allowed during any function. The trustees assured the court that all noise regulations would be respected. The court directed police to ensure that these assurances were being honoured.

The petitioner's counsel stated that appropriate measures have been taken to control noise levels and the court adjourned the hearing till December 7, but ordered that all remedial measures should be brought on record during the next hearing.
