Kim Ikbung, 55, came to India in 2007 and took admission for Bachelor of Arts course in Nawrosjee Wadia College in Pune. He appeared for semester examination, but failed to submit forms for final examination and so could not appear for final examination.

In 2008-09, Pune University and the college ensured Kim filled up the requisite form and issued him a hall ticket. But, chose not to appear for the examination stating by then the syllabus was drastically changed. He again missed his exam in 2009-10. When he again chose not to appear for the examination, the college intimated the Deputy FRRO at Pune about it.

In its letter of September 16, 2009, the college had also recommended not to extend his visa, which expired on March 28, 2008. The Deputy FRRO rejected Kim’s application for extension of visa and instead issued a Leave India Notice to him on September 24, 2010, which has been challenged by the Korean national in his petition.
