The division bench of Justice B.H. Marlapalle and Justice Roshan Dalvi was hearing a petition filed by Debasish Ghosh of Clinical Research Education and Management Academy, seeking quashing of the FIR.

The case of cheating was registered after a complaint was lodged by one of its students, Dr Deepak Devade.

Devade paid about Rs 2 lakh for a course in the Andheri-based institute but failed to secure a job after completing the course. He lodged the complaint two months ago.

“Everybody is expected to join institutes with his eyes wide open,” said the judges.

“Now, even in IIMs there can’t be 100 per cent placement, would it mean that the IIMs cheat their students?” asked Justice Marlapalle.

Additional public prosecutor Dinesh Adsule said the institution had guaranteed jobs to its students. “They are students and where would they go if they are cheated?” he asked. The judges refused to buy the argument.

“They are bound to point out potentials, but not everyone could get a job.”

The court deferred hearing the petition till Friday after Adsule sought time to submit information on similar complaints. He said that though Dr Davade's complaint was settled, there were other students having similar grievance.

The institution, in its petition, has said they haven't assured 100 per cent placement to its students. What was assured by the institution was only assistance in securing job, said the petition.
