MUMBAI: The special NIA court on Tuesday reserved order on the bail application of four accused booked in the 2006 Malegaon blast case until June 6.
The four accused are the second set of accused who are now facing trial in the court. Earlier, the court had discharged nine other accused in the case.
Defence advocate Prashant Maghul and JP Mishra on Tuesday concluded their arguments on the bail applications of the four accused, Lokesh Sharma, Dhan Singh, Manohar Singh and Rajendra Choudhary, booked by NIA for their role in the 2006 Malegaon blast case.
They claimed that the prosecution case is based on imagination and there is no concrete evidence to indicate involvement of these four accused.
However, special public prosecutor Prakash Shetty has opposed the bail application saying that the agency has gathered and submitted enough evidence to show that these were the real accused behind the blast in which 37 people were killed and more than 100 were injured.
The investigation was transferred to NIA on April 6, 2011, after Swami Aseemanand confessed before a court that the 2006 Malegaon blasts was actually the handiwork of a Hindu group. The special court has recently discharged all the Muslim accused arrested by state ATS.
The NIA in their charge sheet claimed t hat their probe was based on the confession statement of Swami Aseemanand who claimed that Sunil Joshi had once informed him that the 2006 Malegaon blast was done by them. Joshi, was a key accused in Samjauta blast case and 2008 Malegaon blast case and was later allegedly murdered. The agency further claimed that bombs were planted by these four accused who are now facing trial.
