Police want to book actor in 2002 hit-and-run case

The Mumbai police, on Wednesday, filed an application in the Bandra Metropolitan magistrate court to book actor Salman Khan under charges of culpable homicide not amounting to murder in the 2002 hit-and-run case that claimed the life of one and left four others injured.

The prosecution is allowed to move the magistrate at any stage of the trial, police sources said. The actor has been asked to file his reply by March 22.

Salman’s advocate Dipesh Mehta, confirming the development, said, “The prosecution has filed an application to book Salman Khan under charge of culpable homicide not amounting to murder in the case.”

He said, “We will go through the application and file our reply on March 22.”

After the incident, Salman had maintained that the incident was an accident and he had no intention to kill anyone. Khan was initially charged under culpable homicide not amounting to murder but the charges were dropped after the Bombay high court’s order.

The high court had held that Section 304 part II of the Indian Penal Code (culpable homicide not amounting to murder) was not applicable in this case and the actor be tried under 304 A of IPC (rash and negligent driving) and other relevant sections.
