The School Bus Owners Association (SBOA) has moved the Bombay high court seeking to stay the operation and implementation of School Bus Rules 2011 till December 2012.
The petition submitted by SBOA states that the association is not against the rules, which are for the safety of school children traveling in various types of vehicles including school buses, but they object to the Regional Transport Office (RTO) demanding that these rules be implemented even though they have not been legislated yet.
Association’s lawyer VP Patil said the rules have not been placed before the state legislature yet and hence cannot be enforced. The petitioners have asked for the state to follow the law in existence prior to the new rules.
Assistant government pleader GW Mattos contended the association was trying to get their permits extended under the guise of challenging the legality of the notification. The matter is likely to be heard on Wednesday.
