Buyers are in an upbeat mood as the Supreme Court on Wednesday allowed the builders and the Noida authority to withdraw a petition asking the Supreme Court to review its 2013 judgment of quashing the land acquired for realty projects.

“SC nod to withdraw builders and the Noida authority review petition means that the land for all group housing projects is now litigation-free. All cases pertaining to group housing land in Sector 107 have been resolved. Therefore, we have decided to pressurise builders to resume construction and deliver flats without further delay,” Punit Parashar, who has booked a flat in Amrapali Heart Beat City, said.

Around 5,000 homebuyers, who had booked flats in four group housing projects -- Amrapali Heart Beat City, Lotus 300, Greater Value Sharnam and Sunworld Vanalika -- have been affected by delay.

In 2013, the Supreme Court had quashed land acquisition of land in Sector 107.

Allahabad high court on June 30, 2014 had ordered a stay on construction of group housing projects following a petition by Maharishi Ved Vidya Peeth, a trust, and a group of farmers, who demanded their agricultural land back.

On July 11, 2016, the high court lifted the stay after the Noida authority assured the court of providing 64% increased land compensation and 10% of the developed land to farmers. Farmers and Maharishi Trust , in an affidavit, told the Allahabad high court they were ready to accept increased 64% land compensation and withdraw their cases.

Builders said that all legal cases have been settled.

“SC allowed withdrawal of our petition. It means the earlier SC order by which farmers are to be given 64% hiked compensation and 10% of the developed plots to settle the land dispute will apply to this case too. Our group will start work in the next 15 days and deliver the promised 1,500 units as soon as possible,” Anil Sharma, chairman-cum-managing director of Amrapali Group, said.

Homebuyers said they will intensify their Twitter campaign on the handle #Ghardilwaoakhileshji, to ensure that builders now deliver flats without delay.

“I have consulted my legal team and I assure my buyers that this land is completely litigation-free. I will restart work on Lotus300 project in September and deliver all 300 units in six towers in a time-bound manner,” Vidur Bharadwaj, director of 3C Company, said.

“We are consulting our legal team to decide our next step but I can assure homebuyers not to worry,” Saumya Srivastava, deputy chief executive officer (DCEO) of the Noida authority, said.
