Noida authority to make a list of under-construction projects

The direction came after chief minister Yogi Adityanath launched on Wednesday the website of the Real Estate Regulatory Authority (RERA) that has been formed to safeguard homebuyers’ interest.

The Noida authority additional chief executive officer (ACEO) Atal Kumar Rai on Wednesday directed the chief architect and town planner Ashok Mishra to make a list of all under-construction realty projects.

The direction came after chief minister Yogi Adityanath launched on Wednesday the website of the Real Estate Regulatory Authority (RERA) that has been formed to safeguard homebuyers’ interest.

The Real Estate (Regulation and Development) Act, 2016, came into effect on May 1, 2016, and the process of forming operational rules and putting in place the institutional infrastructure, to protect consumer interests and promote the growth of the realty sector, was initiated.

As per the October 27, 2016, notification, under-construction projects will not come under the authority if the builder has developed common facilities and applied for an occupancy certificate.

“I have directed the planning department that they should not accept applications for issuing occupancy certificate if the builder has not developed common facilities such as roads, lifts, pool, club and parking facilities. Many builders may rush such applications to get out of the ambit of RERA,” said the ACEO.

“The Noida authority had some time ago started probing cases wherein the builder had obtained occupancy certificate without developing common facilities. However, nothing has come of these probes,” said Vivek Kumar, a homebuyer.

Homebuyers had hoped that after RERA comes into effect, much of their problems will be addressed.

“Now I feel that the Uttar Pradesh government launching the website is just an eyewash because the website is not even complete. Unlike the website of RERA in other states, UP does not have any column where builder will list the exact area of housing land and other crucial details. The UP government, in a hurry due to the Allahabad high court directive, has made an incomplete website. Also, RERA does not even have a chairman or members to help buyers,” said Rajesh Purohit, a homebuyer.
