Residents move SC for stay on toll collection at DND Flyway

The federation of Noida residents’ welfare associations (Fonrwa) moved a special leave petition (SLP) in the Supreme Court on May 9. The federation is seeking a stay on collection of toll at Delhi-Noida-Direct (DND) Flyway. The court will hear the SLP on June 29.

The federation of Noida residents’ welfare associations (Fonrwa) moved a special leave petition (SLP) in the Supreme Court on May 9. The federation is seeking a stay on collection of toll at Delhi-Noida-Direct (DND) Flyway. The court will hear the SLP on June 29.

Fonrwa members said they are disappointed with their three year legal battle for scrapping the agreement signed between the Noida Toll Bridge Company Limited (NTBCL) and the Uttar Pradesh government, through Noida authority, in the Allahabad high court.

“More than 80 hearings have taken place in the high court and no concrete judgement has been given so far. We also filed three petitions in the high court for a stay on the collection of the toll charges by the company but the court did not grant us relief. Now, our legal adviser suggested that we move a fresh petition in the Supreme Court for stay on toll collection. The SLP has been admitted and fixed for hearing,” AN Dhawan, secretary general of Fonrwa, said.

“Subsequently, we had also filed three stay applications in 2013, seeking restriction on NTBCL from collecting toll until our PIL was disposed of by the high court. Our three stay applications were not considered by the high court. Hence we have now been constrained to file SLP in Supreme Court,” NP Singh, president of Fonrwa, said.

“We wish the apex court will grant an ex parte interim order, restraining NTBCL from collecting toll tax on DND Flyway,” Singh said.

Earlier, former Noida MLA Nawab Singh Nagar had also moved a petition in Supreme Court. The petition was rejected and merged with two previously filed petitions in the Delhi high court.
