15-year-old rape victim’s mother seeks court approval for abortion

Police had arrested the victim’s 17-year-old boyfriend on August 9 for allegedly raping and impregnating his teen girlfriend.

The mother of a 15-year-old pregnant rape victim has approached the district court in Chandigarh seeking permission to abort the six-month foetus.

The application will be heard by additional district and session judge Poonam R Joshi on Thursday.

Police had arrested the victim’s 17-year-old boyfriend on August 9 for allegedly raping and impregnating his teen girlfriend. He is facing charges of rape under the Indian Penal Code, and Protection of Children from Sexual Offences (POCSO) Act.

He is currently lodged in the juvenile home after being produced before the Juvenile Justice Board.

The plea comes a year after the same court had rejected the abortion plea of a 10-year-old girl who was raped and impregnated by her maternal uncles.

The uncles were later awarded life imprisonment until death.

The recent case came to light on August 8 when the girl was questioned by her mother about her delayed menstruation. On being questioned about her health, the girl revealed to her mother about being raped.

Her family then took her to a local hospital in Chandigarh where a team doctors after checkup found the girl to be six months pregnant. As the girl is a minor, the doctors sounded the police.

In their complaint to the police, parents of the minor girl alleged that the boy’s mother had died, and when his father would go to work, he would take their daughter to his house and rape her. This had been happening for a few months.

Investigating officials had claimed that the girl’s family had requested doctors to abort the foetus, but they had declined the option.
