As per the information, the minor has recently passed out her 9th Class and had come to her aunt house for-five days ago.

In her statement, the victim alleged that when her aunt (mami) was not at home, aunt's brother identified as Sonu, a resident of Kapurthala, had sexually exploited her.

According to victim, the accused had threatened her not to reveal the incident to any one, otherwise, he would kill her.

Meanwhile, the police have arrested the accused, who is a taxi driver on Thursday and a case has been registered under section 376 of the Indian Penal Code at Kotwali police station.

However, the Kapurthala police have failed to invoke the protection of children from sexual offence (POCSO) Act against the accused.

It is mandatory when any rape case involving the minor occurs, the police have to apply sections of this Act and inform the child welfare committee (CWC).
