The court of additional sessions judge Paramjit Singh on Saturday sentenced 22 people, including former chief of DMC employees' union Chander Mohan Kalia, to three years' rigorous imprisonment in the case of a scuffle between police and agitating staff of Dayanand Medical College and Hospital here in 2002.
The court also imposed a `1,000 fine on each convict under Section 148 (rioting, armed with deadly weapon) of the Indian Penal Code, besides three-month imprisonment under Sections 186 (obstructing public servant in discharge of public functions), two-year imprisonment under Section 332 (voluntarily causing hurt to deter public servant from his duty), one month under Section 188 (disobedience to order duly promulgated by public servant) of the IPC and six months under Section 3 (1) of the Prevention of Damage to Public Property Act. These imprisonments would occur concurrently.
Convict Ram Brij was also convicted under Section 325 (voluntarily causing grievous hurt) of the IPC and given three years, while Sukhwinder Kaur got one year under Section 427 (mischief causing damage to the amount of fifty rupees) of the IPC, besides other charges.
The incident had occurred on July 13, 2002, when the agitating hospital employees had attacked a police party and damaged public property. The division number 8 police had registered a case on the charges of attempt to murder, rioting, assaulting police officials and damaging public property. The hospital remained closed for many days. Police had produced a charge-sheet against 36 people, of which, two later died. The court acquitted 12 for lack of evidence.
