The Chinese nationals were carrying all essential documents, including valid passes, visa and passports, but did not possess the mandatory inner line permit.

Kinnaur superintendent of police (SP) Ajay Bodh told HT that a case was registered under Section 3 (1) of the Criminal Law Amendment Act, 1961, against Gongbin (38) and Yangpeng (36).

“They have been arrested and will be presented in the court ON ????,” he said.

On Sunday, the two Chinese nationals, along with two women from Ladakh and a local driver, were detained in Namgya village located along the Indo-China border near the Shipki-La Pass.

The two accused were arrested after a complaint by the local panchayat pradhan. Police officials said a few SIM cards and 30,000 Yuan were recovered from their possession. They added that the other three were released as being Indians, they did not need the permits.

Namgya is the last Indian village along the India-China border in Kinnaur district. To reach Namgya from China, people need to show inner line permits at the Akpa checkpost on the border. After Namgya, Shipkila village lies in the Chinese territory. This was the same route along which the Indo-China trade takes place.

Section 3 (1) of the Criminal Law Amendment Act, 1961
According to Section 3(1) of the Criminal Law Amendment Act, 1961, the central government may, by notification in the official gazette, declare any area adjoining the frontiers of India a notified area.
