Concerned over the increase in crime against women, Chief Justice of India (CJI) Altamas Kabir stressed on the need for proper and thorough investigation of such cases by the investigating agencies so that lacunas do not remain when the cases come up before the judicial courts.
"Legal remedies are there to punish offenders but for this the case must be presented in the court of law in the proper perspective. If lacunas remain, then it means the case has not been thoroughly investigated," the CJI said while talking to the media after inaugurating a Legal Aid Clinic jointly with chief minister Parkash Singh Badal at Khalsa College here on Saturday.
The Chief Justice also felt that there was a need to change the mindset of the public and of society towards women. Once this happened, then definitely there would be a check in cases of crime against women, he added.
On corruption in the lower rung of the judiciary, the CJI felt that it was just "a generalised feeling" that comes up whenever a case of corruption is reported. Subordinate courts are an important wheel of the judicial system and a generalised remark did not mean that the entire system at the lower level was corrupt, he added.
On the judiciary becoming over-burdened, he did not agree with the viewpoint that this was due to a large number of judicial posts lying vacant. If the population was increasing, so would the number of cases being filed before the court increase, he said, while pointing out that the overall infrastructure of the judiciary needed to be improved.
