The FIR was allegedly registered by Goyal's own son-in-law and IRS officer Dheeraj Garg's driver, Ram Chand, in January last year. As per the FIR, Goyal, a 1995 batch IAS officer, had allegedly committed fraud during his tenure as Kurukshetra deputy commissioner, by allotting construction work of municipal committee shopping complex to Sarottam Construction Company, in 2005. Presently, Goyal is posted as secretary of Human Rights Commission of Haryana and Garg as deputy commissioner of income tax at New Delhi.

Goyal also alleged that the present FIR was a proxy FIR by Garg with the help of Congress cabinet minister Randeep Singh Surjewala in order to harass him. He had alleged that not only this, but Garg had got lodged a number of cases against him and his family just to settle scores and to pressurise the petitioner to accede to his illegal demands of divorce with petitioner's daughter.
