The Bandra magistrate’s court on Monday granted surety bail to the 25-year-old woman from Manipur, who was allegedly molested by a gang of four men and arrested as she hurled a stone at one of the men in Kalina, early on Sunday. Three of her other friends, all from the same state, too were granted bail.
Confirming this development, their lawyer, Mohammad Azad, said,”The court has given a memo which their friends will have to produce before the jail authorities. After furnishing required documents, they can be out.”
Senior police inspector Mahadev Wavale of Vakola police station said, “We are on the lookout for the third accused. We are also investigating if a fourth person was involved.”
The incident took place on Sunday at 1.30am, when Ningrin Zimik and the woman were waiting for an auto rickshaw at in Kalina to go home. Three men allegedly called them “Nepali” after which the argument began. They caught Zimik’s neck and when the woman intervened they hit her.
An injured Zimik then asked the woman to go back to the friend’s home and get the others to the spot. Some of their friends had already come out of their building on hearing the chaos. The woman, who was being followed by the trio, narrated the ordeal to her friends and a fight ensued, said police.
The police registered two cross-complaints. Zimik’s friends - David Aso Marza, 32, Apam Bhav Shimre, 24, Thangmi Shibre, 26, and the woman who was molested – and two from the group -- Sudharshan Gaikwad, 46, and Deepak Gandhala, 25 - were been arrested.
“The molestation section was added to the complaint because the woman was slapped. She has been booked because she threw a stone at one of the accused, who had started to bleed,” said Wavale.
While Zimik’s friends have been booked under sections 324, 323, 504 and 34 of the Indian Penal Code (IPC), amounting to assault, assault by weapon, intentional insult and common intention. All of them were sent to judicial custody.
While the three men has been booked under section 452 (house-trespass after preparation for hurt, assault or wrongful restraint), 323 (hurt), 354 (criminal force on a woman), 504 (intentional insult), 506 (criminal intimidation) and 34 (common intention) of the IPC, two have been arrested and sent in police custody for two days.
