HC refuses to stay UPSC meeting on promotion of PPS officers
The Punjab and Haryana high court on Monday refused to stay the Union Public Service Commission's (UPSC's) scheduled meeting on June 6 regarding the promotion of Punjab Police Service (PPS) officers to the Indian Police Service (IPS). However, the court said the UPSC's decision would be subject to the outcome of the pending case in the high court.
The Punjab and Haryana high court on Monday refused to stay the Union Public Service Commission's (UPSC's) scheduled meeting on June 6 regarding the promotion of Punjab Police Service (PPS) officers to the Indian Police Service (IPS). However, the court said the UPSC's decision would be subject to the outcome of the pending case in the high court.
The development took place on an application moved by Narinder Bhargav, senior superintendent of police (SSP), Mansa, before the vacation bench headed by justice Mahesh Grover. The court also issued a notice of motion to the Punjab government on the application for submitting its reply by July 10.
The petitioner had sought stay on the promotion meeting since he had already challenged the PPS officers' seniority list before the high court earlier which was pending for final decision. Bhargav had sought quashing of the seniority list of 523 PPS officers finalised by the state government on January 29, in which about 21 police officers were shown senior to him despite the fact that he had joined the service before them on May 11, 1993.
The SSP had also sought quashing of rule 10 of the PPS Rules, 1959, since it determines seniority of police personnel from the date of confirmation of service and not from the date of joining. The petitioner had earlier informed the court that the director general of police (DGP) had initiated the process of preparation of 'select lists' for 2010, 2011 and 2012 onwards for the promotion of state police service officers to the IPS and letters had been issued to 14 officers who had joined service after him to fill the requisite per forma.
