Based on the woman’s complaint at Sector 53 police station on March 17, the man and his accomplice were booked under Section 376D (gang-rape) of the Indian Penal Code. However, before they could be arrested, investigators determined that the case against them was registered with the motive of extorting money.

The facts were revealed when the woman testified in favour of the suspects before a judicial magistrate on March 18 under Section 164 (recording of confessions and statements) of the Code of Criminal Procedure, said deputy commissioner of police (east) Virender Vij.

According to investigators, the woman worked as a web designer for a private firm in Noida and had met a Gurugram man on Facebook a few years ago.

“In a first information report filed on March 17, she claimed that she was gang-raped the day before by her boyfriend and his accomplice in a hostel in Sector-53,” said Vij.

According to police, the woman had claimed in her FIR that her boyfriend summoned her from Noida to Gurugram for a court marriage but instead sent her to a hostel with his friend. She claimed that after gang-raping her, the suspect returned to the hostel and threatened her with dire consequences.

“We were surprised by the sudden change in her statement, which was contrary to her allegations in the FIR. When we investigated further, we discovered that she asked the prime suspect’s brother to give her 4 lakh in return for giving a favourable statement to weaken the false case. So, the brother transferred 2 lakh into her bank account, and she gave a favourable statement before the judicial magistrate,” Vij added.

According to Vij, during the investigation, officers discovered that the woman had also filed a similar case against other people at the Aman Vihar police station in Delhi ten months ago and the same language was used in both the complaints.

According to DCP Vij, a separate FIR was filed against the woman on Thursday at Sector 53 police station under sections 384 (extortion), 385 (putting a person in fear of injury to commit extortion), and 389 (putting a person in fear of accusation of offence to commit extortion).
