Jaypee Greens illegal helipad: Ensure compliance with your undertaking in court, High court tells Greater Noida authority

The Allahabad high court has directed the Greater Noida authority to adhere to its rules and comply with its undertaking given in court, while dismissing the plea filed by Jaypee Greens’ residents against the Jaiprakash Group over the illegal helipad at the luxury residential project.

After the High Court order, the illegal helipad at Jaypee Greens in Greater Noida has been demolished.

The November 21 order, which was uploaded on the high court’s website on Thursday, came after the Greater Noida authority said in an undertaking that the helipad has been demolished and will not operate illegally.

“In compliance of the said order (November 3), the chief executive officer, Greater Noida has filed an affidavit admitting that the helipad was constructed without obtaining permission of the authority. It is stated that the structure raised for the said purpose has been completely demolished. Anjali Upadhya, counsel for the Greater Noida, states that the said activity will not be resumed unless approval from the authority is obtained. Having regard to the above stand of the authority and the statement made in this behalf by the counsel appearing for the authority, we are of the opinion that no direction is required to be issued except that the authority will ensure compliance of the undertaking given before this Court. The petition stands disposed of, accordingly,” said the high court order delivered by justice Jayant Banerji and justice Manoj Kumar Gupta.

The wings, maintenance, repair and operation (MRO) facility of helipad was demolished on November 11 in response to an order issued by the Allahabad high court on November 3, directing the Greater Noida authority to act on plea filed by Jaypee Greens residents’ welfare association. The plea, filed in August 2021, sought a direction to demolish the helipad and MRO facility functioning out of Jaypee Greens.

But on Thursday, residents said the Greater Noida authority is yet to demolish the concrete platform on which the helicopter used to land. They say this area has been occupied illegally by the helipad and should be developed into a green space.

“The concrete surface and the platform made for the helicopter is yet to be razed by the authority according to the high court order,” said Shubh Gupta, a resident of Jaypee Greens.

The Greater Noida authority said they are examining the high court order.

“We got the MRO facility, wings and other structures removed from the site according to the high court order. Our legal department is examining the court’s November 21 order for compliance,” said Salil Yadav, general manager of the Greater Noida authority.
