Contempt notice to RCS for delay in flat allotment

The Delhi High Court on Monday issued contempt of court notice to the Registrar of Cooperative Societies (RCS) and his deputy for not taking steps to allot flats to members of 57 group housing societies in Dwarka despite an order of the court two years ago.

The court was especially furious that the RCS had not complied with its orders in November 2009, January and February this year to speed up the process in the interest of 6,000 families who were just about to move into their dream flat eight years ago but faced uncertainty due to the Rs 4,000 crore group housing scam and court stay orders that followed.

For these families, August 25, 2008 was a red letter day.

The court had directed RCS to scrutinize documents of these societies were construction was complete and allot flats to members not involved in the scam unearthed in 2004 and being probed by the Central Bureau of Investigation (CBI).

After receipt of complete documents from the societies, the documents were to be scrutinized by the Registrar Office within 15 days and allotment to genuine members were to be recommended to the DDA.

But the trigger to the contempt notice was submission by D K Garg, the lawyer for the sealed Raj Vihar CGHS that scrutiny process of the society was not complete despite the documents submitted way back in September 2008.

The CBI too called the bluff of the RCS telling the court on February 15 that it never refused inpection of the seized records.

The court even had allowed inspection of the photocopies of the records which the CBI said were readily available.

Monday's court order assumes importance as members of six societies, frustrated over the delay had held self-draw of lots and begun moving into their flats.

The step was declared illegal by the RCS and Delhi Government who threatened to lodge FIR against the members.
