Disturbing trend, says CPM

The CPM on Tuesday said that High Court’s verdict for the division of land based on “faith and belief” is disturbing as it will set a dangerous precedent.

The CPM on Tuesday said that High Court’s verdict for the division of land based on “faith and belief” is disturbing as it will set a dangerous precedent.

“The verdict for a three way division of the land is, however, based on faith and belief. This aspect of the set of judgments is disturbing as it accords primacy to religious belief and faith over and above the facts and the record of evidence. It will set a dangerous precedent for the future”, party general secretary Prakash Karat said after a two-day meeting of the CPM politburo.

Karat hoped this aspect will be addressed when the matter goes to Supreme Court. “The politburo of the CPM reiterates that in the secular democratic set-up ordained in the constitution, the way to resolve the matter is through the judicial process and the decision of the SC would be final,” he said.

The party also said that the cases pertaining to the demolition of Babri masjid need to be seriously pursued, pointing out that the reasoning set out in the judgment of the Allahabad High Court may be taken as a “post facto justification” of razing the mosque.
