The offending vehicle was being driven by driver of offending vehicle (Daryao Singh). It was owned by DJB (Delhi government) and, therefore, Singh is the principal tortfeasor. Singh and DJB are vicariously liable.

The accident took place on March 29, 2010, when Najafgarh resident Yadav was going to his office on his motorcycle and suddenly the speeding tanker, which was driven by Singh in a rash manner, hit the victim.
