Govt clears Yadav transfer, once again

For the second time in less than a year, the government on Tuesday once again cleared the controversial Punjab and Haryana High Court judge, Nirmal Yadav, for transfer to any other state, reports Nagendar Sharma.

For the second time in less than a year, the government on Tuesday once again cleared the controversial Punjab and Haryana High Court judge, Nirmal Yadav, for transfer to any other state.

The Union Law Ministry is understood to have stuck to its previous stand that no case of corruption is made out against the judge, HT has learnt.

The ministry’s assertion follows a query from the President on the status of the CBI probe against Justice Yadav in the cash-at-door scam in Chandigarh. Yadav faced allegations of being the beneficiary of Rs 15 lakh from a lawyer’s clerk.

Rashtrapati Bhawan had in November returned the file to the ministry containing the recommendation to transfer her to the Uttaranchal High Court, highly placed sources said.

The collegium recommendation was based on the opinion given by former Attorney General (AG) Milon Banerjee in April 2009, that the evidence gathered by the CBI was “insufficient, which did not merit launching prosecution” against Justice Yadav. The ministry’s latest view is understood to be based on the revised “limited opinion” given by the present Attorney General G. E. Vahanvati, sources said.
