HC dismisses appeal of murder convicts

The case pertains to the murder of a senior citizen in the posh South Extension area by Vikram and Vinod 17 yrs ago.

The Delhi High Court has dismissed an appeal by two men, sentenced to life imprisonment in a murder case, who contested the testimony of an eye-witness as she was the daughter of the victim.

The case pertains to the murder of senior citizen RS Tuli in the posh South Extension area of the capital by Vikram and Vinod 17 years ago.

Upholding the trial court order convicting the duo, a Division Bench of Justice R S Sodhi and Justice PK Bhasin said "from the testimony of Komal (daughter) there is nothing that should lead us to believe that she was an unnatural witness."

"We find no exaggeration in her statement nor is there anything on record to show that Komal had any ulterior motive to implicate the accused persons or that she would substitute the real killers with the accused," the Bench observed and rejected the submission made by the counsel for the accused that her testimony should not be given importance for the reason that her behaviour did not appear to be natural.

Komal was away to her office and in the evening finding no other family member present at home, the accused had attacked on the old man.

After killing the man, they were in the process of ransacking the whole house, when Komal reached home. She was also threatened by the accused.

However, neighbours gathered following her shouts for help and the two were caught.
