HC questions legal knowledge of tribunal members

The Delhi High Court has expressed "serious" doubts over legal knowledge of members of the Tribunal under the Maintenance and Welfare of Parents and Senior Citizens Act and suggested the government to ensure their "competence", reports HT Correspondent.

"The Tribunal acted beyond its jurisdiction. This even raises serious doubt about the legal knowledge of the members of the Tribunal and their competence to act as such," observed Justice Shiv Narayan Dhingra, setting aside the Tribunal's order cancelling the gift deed executed by former DU professor Lotika Sarkar in the name of Preeti, wife of Bihar cadre IPS officer Nirmal Dhoundial.

The order said, "It is advised to the government that before constituting a Tribunal, the government must ensure the competence of members and that the members have basic knowledge of law...and they should have respect for legislative enactment and respect for common man."
