The court was hearing a petition filed by an environmentalist Vinod Kumar Jain of NGO 'Tapas'. He said despite the high court order of 2006 and also the then MCD's undertaking in 2009 for the construction of 13 special permanent enclosures, there wasn't much headway.

Justice Rajiv Shakdher was not happy with the assurance from the Delhi Government that work was almost complete at nine enclosures and four others were being readied. A status report has been sought by March 5, 2013.

Jain alleged that every year, the MCD makes temporary ghats during the festival season but most of them are still in a dismal condition. The court has been repeatedly asking the Delhi government, DDA and MCD as to why contempt of court proceedings should not be initiated against them for not complying with its orders to stop pollution of the river.

He pointed out that the court had even directed the government in 2006 to effectively enforce the Delhi Degradable Plastic Bag and Garbage (Control) Amendment Act to ensure Yamuna's cleanliness during festivals.
