HC upholds professor's appointment

A bench of justice Pradeep Nandrajog and justice Siddharth Mridul asked the AIIMS to appoint Dr Anand Kumar to the post. His appointment was quashed by the Central Administrative Tribunal in 2000.

The court pulled up the tribunal for quashing the appointment, saying it had approached the case with a "foreclosed mind".

The tribunal had quashed Anand's appointment after holding that he did not have the requisite qualification of MD degree in reproductive biology and has degree in Physiology.

The high court, after going through the syllabus of different courses, came to the conclusion that Anand is holding a degree equivalent to the requisite qualification and no college in India awards a MD degree in reproductive biology.

"It has surprised us that the tribunal has commenced the journey by recording that Dr Anand Kumar does not possess a post-graduate qualification or a recognised qualification equivalent thereto...," the court said.
