Party spokesman Shivanand Tiwari said that the ball is now in the Prime Minister's court following the affidavit, "which showed that the PMO was in the loop at every stage."

"If this was so why the Prime Minister did not intevene. Now the resignation of Raja has become secondary and the explanation of the Prime Minister has become primary as he was being sought to be implicated," Tewari told PTI.

The Telecom Ministry yesterday filed an affidavit in the Supreme Court in which it asserted that all licences along with 2G spectrum were given "as per law and in keeping with the extant policy and procedures".

The affidavit said that all decisions with regard to 2G spectrum allocation in 2008 were taken as per government policy that was being followed by all his predecessors since 1999.

DoT also denied the allegations that it ignored advise of Prime Minister, Finance Secretary and Ministry of Law and Justice (MoLJ) over allotment of spectrum.

"This is wholly incorrect," the DoT said adding that MoLJ advice to reffer the matter to Empowered Group of Ministers was "not necessary on such procedural issue, since no policy issue was to be examined".

It further said that "there was no difference of opinion between the two ministries", DoT and Ministry of Finance.

Undeterred by the mounting opposition attack on his role in 2G spectrum allocation, Raja today ruled out resignation over the issue, saying he will prove that everything has been done according to the law.
