The Supreme Court has ordered to prosecute a rape victim for retracting her statement that she made while deposing against her father, leading to his conviction in the case.

The girl did a volte-face a few days after the Supreme Court reversed a Himachal Pradesh court order and convicted her father Asha Ram. She had sought setting aside the apex court order, stating she had deposed against her father in the trial court under her mother’s duress.
A special bench comprising Justices HK Sema and PP Naolekar dismissed Asha Ram’s plea seeking review of his conviction by the apex court. Asha Ram had prayed for his innocence, citing his daughter’s affidavit. Rejecting the review petition, the bench asked a trial court in Shimla to prosecute the girl under sections 191, 192 and 193 of the Indian Penal Code for making false statements before the apex court in her affidavit.
