‘Zakia entitled to SIT closure report’

The Supreme Court on Thursday directed the Special Investigation Team (SIT) to furnish all the documents to Zakia Jafri that were submitted before the trial court as a part of its closure report.

In the report Gujarat chief minister Narendra Modi has been given a clean chit in the 2002 Gulburg Housing Society riot case in Ahmedabad.

Sixty-nine persons including Jafri’s husband and former Congress MP Ehsan Jafri was killed during the riots.

A bench of Justice P Sathasivam, Justice Aftab Alam and Justice Ranjana Prakash Desai said the documents should be supplied to Jafri to enable her to file a protest plea against SIT’s closure report.

The court gave her eight weeks to do so. It was, however, clarified that the report shall be supplied without the comments of the SIT chief.

Setting aside Ahmedabad trial court’s order of July 16 and November 27 last year, the bench said: “We clarify that the petitioner (Jafri) is entitled to entire inquiry report placed in sealed envelope before this court on May 12, 2010.”

Sadiq, a Mumbai gangster from Gujarat, was killed in Ahmedabad in January 2003. The Gujarat police claimed he was a Lashkar-e-Taiba militant on a mission to kill chief minister Narendra Modi.

Vaghela, then an inspector with the Detection of Crime Branch, Ahmedabad, was part of the team which allegedly killed Sadik.

But Sadiq’s brother Sabir contended he was killed in a staged shootout by Ahmedabad police after they got his custody from the Mumbai police.

In June 2011, the Gujarat high court ordered a CBI probe into the case. CBI had arrested eight men in the case so far. HTC
