Gustad sent to police custody till June 10

A Mumbai court gave Rly Police custody of Gustad and his associate till Jun 10 in Nadia death case.

A local court on Wednesday suo motu charged noted directer Kaizad Gustad and his assistant Ashish Udeshi with culpable homicide not amounting to murder in connection with the accidental death of upcoming director Nadia Khan at Mahalaxmi railway station on May 25.

Both of them were arrested by Government Railway Police and produced before a magistrate's court in Girgaum which rejected their bail plea and remanded them to police custody till June 10.

A lady constable, Darshana Waiti, who was present at the Mahalaxmi railway station when the UK national Nadia Khan was knocked down by a speeding local train during shooting of Gustad's film, was also arrested and produced before the court. However, she was granted bail on a bond of Rs 6,000.

Darshana was charged with section 201 (causing disappearance of evidence or giving false information to screen offender).

Gustad and his assistant were also charged with section section 182 IPC (false information with intent to cause public servant to use lawful power to the injury of another person).

Police had booked Gustad and Udeshi under section 304 IPC (causing death by negligence) which is a bailable offence. However, the court rejected the police charge and suo motu took cognizance of section 304-A (culpable homicide not amounting to murder) and charged the duo with this offence.

Gustad's lawyer Sayaji Nangre argued that his client should be granted bail as he had already given his statement to the police and nothing remained to be recovered from him.

Magistrate Usha Iyer rejected the bail plea as section 304-A is a non-bailable offence.
