While giving this verdict, the court, however, made it clear that re-examination for BTC would be conducted by the State Government only among the candidates who had undertaken this cancelled examination.
In the judgment, Justice VK Shukla also made it clear that this order would not prevent the State from undertaking subsequent BTC examination-2005 or any other examination in this respect.
This order was passed by the court on several writ petitions filed by Vinod Kumar Yadav and others after hearing counsel for the petitioners and Chief Standing Counsel CB Yadav, who represented the State Government.
To recall, following the investigation made by Vigilance, some irregularities were found in BTC Examination-2001. On the Vigilance report, the Secretary Basic Education on October 20,2005 cancelled the BTC Exam-2001. This cancellation order had affected lakhs of students of the state. The petitioners had challenged the cancellation order.
