Court declares Yogi?s detention illegal

District judge Amar Sinha on Tuesday declared the detention of BJP MP Yogi Adityanath illegal under section 151 of the Indian Penal Code.

District judge Amar Sinha on Tuesday declared the detention of BJP MP Yogi Adityanath illegal under section 151 of the Indian Penal Code. Sinha had earlier reserved his order on Monday after completing the hearing.

Advocate Devesh Vaishya, himself one of the detainees, argued that Yogi's detention for more than 24 hours in district jail was illegal. He quoted various verdicts of the Supreme Court and the High Courts. The decision has paved the way for release of about 94 persons, including MLA RMD Agrawal and MLC Dr YD Singh. They had been arrested on January 28.

In another case, in which the judicial custody of Yogi Adityanath was challenged by advocate Ajit Srivastav, the court has fixed February 7 for hearing. Meanwhile, police arrested four persons for spreading rumours.
