He also asked the court officials to withdraw the notices issued against them by the court earlier. The court stated that since Premji and Kumar did not come under the category of domestic relationship with the petitioner, as required for making them a party under the said act, their names should be deleted from the case and the notices issued to them be withdrawn. The order also stated that wrong details were provided in the case.
Tripti Nigam had filed a petition before the CMM against her husband Gaurav Nigam, an engineer at Wipro, Premji and Kumar under the section 12 of the Domestic Violence Act-2005 on November 22. The petition said that the dating allowance paid by Wipro to its employees encouraged them to indulge in illicit relationship. It was setting a wrong example in the society and many families were on the verge of breaking up as a results of the allowance, Tripti claimed.
She further said that Gaurav too had established illicit relationship due to the allowance and had filed a divorce case in the Lucknow family court. He had also left his son, Tripti alleged.
The court had issued notices to all the three named in the petition on November 22 and fixed today as the next date of hearing. Court sources said that Gaurav appeared before the court and requested a time of 20 days to file his objections. The court has fixed December 13 as the next date of hearing.
In the mean time, petitioner Tripti submitted an application to the CMM seeking removal of the names of opposite party number two (Premji) and three (Kumar).
Talking to newsmen, Tripti’s counsel, Nand Lal Jaiswal said that when he came to know that the Domestic Violence Act did not permit to make one a party other than domestic relatives, he advised his client to move an application seeking withdrawal of the names of Premji and Kumar. However, he said that legal battle against payment of the dating allowance by WIPRO would continue.
