"Notwithstanding the Presidential decision there has been inordinate delay in the matter and as such Dhananjoy Chatterjee deserves commutation of his sentence," Sekhar Basu, Chatterjee's lawyer said on Wednesday.
He said 43-year-old Chatterjee could now file a petition under Article 32 of the Constitution before the apex court.
Article 32 confers the right to move the Supreme Court for enforcement of fundamental rights.
Chatterjee's brother had moved the apex court on June 24, a day before the scheduled hanging, challenging the rejection of the mercy petition by the Governor of West Bengal. But the court had declined to entertain it since the mercy petition was under consideration of the President then.
