Four lawyers awarded imprisonment

THE ALLAHABAD High Court on Friday awarded four lawyers of Ambedkar Nagar district one month’s simple imprisonment. They were convicted under the Contempt of Court Act.

A Division Bench of the High Court comprising Justice Imtiyaz Murtaza and Justice Ravindra Singh passed the order on a reference made by the district judge, Ambedkar Nagar regarding the lawyers’ act.

The lawyers were charged with using abusive language against an additional civil judge (junior division) Ram Bilas Singh of Ambedkar Nagar district.

Those who were convicted included Ambedkar Nagar District Bar Association president Ganesh Prasad Verma, Anil Tiwari, Dilip Tiwari and Rajesh Kumar Singh.They have also been directed to pay fine of Rs 2000.

Punishing all the four lawyers, the Court made it clear that if the lawyers failed to deposit the fixed amount, they would suffer two months’ further simple imprisonment.

The court said that punishment imposed should be kept in abeyance for a period of 60 days to enable them to approach the Supreme Court, if so advised. The court ordered the police to take the lawyers into custody.

Judgement reserved

The High Court reserved its judgement on a bail application filed by a person who was charged with murdering Suresh Singh Yadav, an HC lawyer.

Justice Vinod Prasad passed the order on a bail application filed by Jai Prakash alias Pintoo.

According to prosecution, Suresh Singh Yadav, an HC lawyer, was shot at in Civil Lines on September 20, 2005. Later, he died at the SGPGI Lucknow on October 13, 2005.

Arguing on behalf of the applicant, his counsel JS Senger contended that the lawyer was in coma, could not give any dying declaration or any statement
disclosing the names of those who were involved in attacking him.

Opposing the bail application, additional government counsel Sudhindra Kumar, contended that the statement of Yadav was recorded after obtaining prior permission of the doctors.

The statement recorded for 45 minutes proved motive part of the attack.

Besides, the accused tried to run away from the police custody, Kumar argued. Hence, he not entitled to bail.
