Gustad's bail plea to be heard today

The bail petition of Kaizad says that since he had already recorded his statements, hence he should no longer be kept in custody.

A Railway court will hear the bail pleas of film director Kaizad Gustad, his assistant Ashish Udeshi, and crew member Hadley D'Mello on Monday.

The three have been arrested in connection with the death of assistant director Nadia Khan, who was reported to have been hit by a speeding train when Gustad's film Mumbai Central was being shot at Mumbai's Mahalaxmi railway station.

They had been booked for the offence of causing death by negligence. The charge was subsequently rejected by the court, and changed to that of culpable homicide not amounting to murder.

Gustad and his colleagues had been remanded to custody on the ground that the police investigation was incomplete and statements of witnesses were still being recorded.

However, their bail petitions said that since the three had already recorded their statements, they should not be kept in custody any longer.

Defence lawyers also said that 304 part two IPC (culpable homicide not amounting to murder) was not applicable in the case of the accused.

Police have already recorded the statements of 16 witnesses, including a woman who had seen Khan's body lying on the track.

Executive director of the film Ayesha Shroff, who had submitted negatives of the film shot at the railway station to Government Railway Police (GRP), has also recorded her statement.
