The state government moved the apex court contending that the state advisory board scrapped invocation of NSA against Gandhi ignoring "cogent evidence" of the state government for invoking the NSA against him.

The filing of the petition in the apex court's registry was confirmed by Uttar Pradesh's advocate-on-record GV Rao.
