Novelty needed to secure patent, says NIC director

SENIOR TECHNICAL director of the National Informatics Centre (NIC), Ministry of Information Technology VK Bali on Tuesday said novelty was an important aspect for securing a patent.

He was delivering a lecture on ‘State-of-Art Searches: What, When and How?’. The lecture was part of a national workshop on ‘How to Draft Specification and Prosecute Indian Patent Application’. The National Research Development Corporation organised the workshop at a hotel in Nadesar.

“In order to establish a novelty aspect of the invention, the appropriate data bases, giving patent information, has to be searched before filing a patent application otherwise the patent office will reject it due to lack novelty. Thus, all the expenses incurred by any the inventor concerned for filing application will go waste,” he said.

He also gave a demonstration of all the websites and retrieved information during the session. He provided information to the audience about the websites set up by NIC ().

Addressing the seminar, joint director (Intellectual Property Rights) at Defence Research and Development Organisation Avinash Kumar dwelt upon ‘Patenting Abroad: Various Options’.

He said foreign patenting was costly, but invention should be protected in all foreign countries if it had market potential in those countries.

Former Assistant Controller of Patent Office (New Delhi) SK Pangasa delivered a lecture on ‘Indian Patent System: Protecting Biotech Inventions’. He spoke about Indian Patent System and how the inventions were being protected; and what were the rules and regulations to secure a patent in India.

Indira Banerjee, a practicing patent attorney with M/s Davar and Co. (Kolkata) spoke about ‘Drafting and filing a patent application’.

Addressing the seminar, assistant controller at Patent Office (Kolkata) A Chakravorty spoke about how an application submitted by any inventor with Patent Office was examined.
