In yet another relief to Jalandhar senior deputy mayor and Akali leader Kamaljeet Singh Bhatia, a local court on Monday acquitted him in a 2012 case involving charges of alleged trespass and theft.
Jyoti Sarup, the owner of Oriental Tools Corporation at Basti Guzan, had filed a complaint in the court against Bhatia and Paramjeet Singh, a municipal corporation contractor, on January 29, 2012 in this connection.
A lower court had issued summons to the two on November 5, 2012. Bhatia then approached the higher court to challenge the summons but the court dismissed his revision petition.
They were ordered to face trial for offences punishable under sections 452 (trespassing), 166 (public servant disobeying the law), 167 (public servant framing incorrect document), 427 (mischief), 382(theft made after preparation), 511(offences punishable up to life imprisonment), 411(dishonestly receiving stolen properties), 414 (assisting in concealing stolen property), 201(causing disappearance of evidences), 506(criminal intimidation), 148 (rioting armed with deadly weapons), 149 (unlawful assembly) and 120-B(criminal conspiracy) of Indian Penal Code (IPC).
Sarup had claimed that on September 22, 2010, Bhatia and Paramjeet opened the doors of his business outlet and illegally got a part portion of his property razed using MC machinery without issuing a notice, which is followed under the Municipal Act.
On his acquittal, an elated Bhatia said he had trust in the judiciary, claiming that the demolition was done after following all guidelines and procedures mentioned in the Municipal Act.
On Saturday, Bhatia was acquitted in a case involving alleged use of abusive language against then then Maqsudan station house officer (SHO) in November 2008.
