Supreme Court issues notice on Gautam Navlakha’s plea for default bail

- Navlakha claimed in his petition filed through advocate Shadan Farasat that the 90-day period for filing of charge sheet was over and he was entitled to default bail under Section 167(2) of the Code of Criminal Procedure (CrPC).

The court’s comments came a day after Navlakha’s partner Sahba Hussain alleged that the 70-year-old activist, who is facing charges under the Unlawful Activities (Prevention) Act, found that his spectacles had been stolen inside jail, and that prison authorities didn’t permit a replacement.

A division bench of Justices S S Shinde and M S Karnik said it has learnt about how spectacles of Navlakha were stolen inside jail and the prison authorities refused to accept the new spectacles sent by his family through courier.

The Pune Police had arrested these three activists along with two others - poet P Varavara Rao and Gautam Navlakha - on August 28 in connection with the Elgar Parishad conclave held in Pune on December 31. These civil rights activists were charged with inciting violence at Bhima Koregaon the next day as per the investigations done by Pune Police.
