Arbitration fee case: HC summons SR Ladhar

A Punjab and Haryana high court bench on Tuesday directed SR Ladhar, principal secretary, planning, Punjab, to be present before the court on Wednesday for non-compliance of court orders by not refunding the illegal arbitration fee collected by him from state farmers as divisional commissioner.

A Punjab and Haryana high court bench on Tuesday directed SR Ladhar, principal secretary, planning, Punjab, to be present before the court on Wednesday for non-compliance of court orders by not refunding the illegal arbitration fee collected by him from state farmers as divisional commissioner.

The high court bench of justice Rajesh Bindal observed that Ladhar had failed to comply with the orders. “Considering the conduct (of Ladhar)”, he is directed to appear in person in court on Wednesday. However, for appearance in court, he would not be treated on duty, the high court bench said.

Earlier, petitioner advocate HC Arora had submitted that an affidavit was filed by Ladhar, wherein he had not given full particulars of the arbitration cases dealt with by him as arbitrator, nor had he paid to the government the total amount of arbitration fee collected from farmers. The petitioner argued that Ladhar did not deposit the Rs 11.17 lakh shown as stipend disbursed to his staff at that time, thus, wilfully defying the court orders.

The government has told the court that the total amount refundable was being verified, but tentatively the amount had been calculated at Rs 2.85 crore. Ladhar has deposited only Rs 1.16 crore with the government. He is accused of illegally charging crores from the farmers for arbitration proceedings for determination of compensation for the acquired land under the National Highways Act.

In October 2013, the high court had directed Ladhar to refund the entire amount. The conduct of Ladhar, a 1991-batch IAS officer, had come under scrutiny after a series of reports in HT.
